Key Updates to LMIA Rules (Effective September 26, 2024)

Refusal to Process LMIA Applications in High-Unemployment Areas

  • LMIAs for low-wage positions will not be processed in areas with an unemployment rate of 6% or higher unless exempt.
  • Exempt Sectors: Primary agriculture, seasonal positions under 270 days, and certain roles in food manufacturing, construction, and healthcare.

Reduction of Low-Wage Workforce Cap

  • Employers are now limited to hiring a maximum of 10% of their workforce as temporary foreign workers in low-wage roles (previously 20%).
  • Exceptions: Food manufacturing, construction, and healthcare sectors can hire up to 20%.

Reduction of Work Permit Duration for Low-Wage Positions

The maximum duration of employment for low-wage workers is reduced from two years to one year.

Dual-Intent LMIA Applications

Requirements for dual-intent (supporting both temporary work and permanent residency) now align with the updated low-wage and high-wage rules.
